Rejoining Employment: An Option After Retirement


Havana, August 2nd.- The Ministry of Labor and Social Security of Cuba (MTSS, for its acronym in Spanish) confirmed that, among the requirements to be entitled to retirement, set forth in Law 105 on Social Security, it remains unchanged that the age is 60 years for women and 65 in the case of men.

For this purpose, and in order to set the age for obtaining the right to an ordinary pension, jobs are classified according to the nature of their respective conditions, into two categories: one for jobs performed under normal conditions, and another for those jobs performed in conditions in which the expenditure of physical, mental, or both energies, is of such a nature that it causes a reduction in labor capacity over time, by producing a wear and tear on the organism that is not consistent with that corresponding to the worker's age.

The standard clarifies that, in order to determine the jobs in the second category, the MTSS will have the advice of the Ministry of Public Health, the union and other involved organizations.

In such a way, for category one -which is the most common- workers must meet the requirements of women being 60 years or older and men 65 years or older; having provided no less than 30 years of service; and being employed.

In addition to that, in 2021, Decree-Laws 36 and 39 were established, amending Law 105 and its regulations, respectively, which establish, among other things, the reincorporation into employment of retired workers, occupying the same position they had at the time of retirement and the possibility of earning the salary of the position and, in addition, the retirement pension.

This allows the retiree to have higher income, while also being obligated to prepare recent graduates to perform those tasks.

Similarly, those who rejoin employment, when they decide to stop working, have the right to increase the amount of their pension, only once; for this, the salary they are earning in the current position is taken as a reference and, for each year worked, the amount of the pension is increased by 2%.
