Trial prepared against instigators and mentors of coup in Brazil

Brasilia, Jan. 15. - The Supreme Federal Court (STF, by its acronym in Spanish) of Brazil is today preparing the trial against the instigators and mentors of the coup attempt that on January 8 marked two years since it occurred in the capital's headquarters of the Three Powers.

On that date in 2023, marked in black in national history, radical followers of former President Jair Bolsonaro, dissatisfied with the result of the previous year's elections, invaded and looted the National Congress, the STF and the Planalto Palace, the seat of the Power Executive.

According to the electronic magazine Consultor Jurídico, since then, 898 defendants have been criminally responsible, and until now, the Supreme Court has focused on the executors of the coup attempt, not on the instigators and guides of the antidemocratic acts, which should change in 2025.

The high court has launched 15 investigations to determine the conduct of the executors, instigators and financiers of the coup episodes.

The trend, according to ministers consulted by the publication, is that the investigations of the Federal Police (PF) will conclude and the Attorney General's Office (PGR, Prosecutor's Office) will file complaints against the intellectual authors of the plot, which should begin to be analyzed this year.

Bolsonaro, members of his government (2019-2022) and businessmen are among those who may be tried criminally in 2025.

Such a trial must be made by the first court, composed of ministers Cristiano Zanin, Carmen Lucia, Luiz Fux, Alexandre de Moraes and Flávio Dino.

In November 2024, one day after the bomb attack in front of the STF, Minister Luís Roberto Barroso, president of the court, stated that the investigations were close to conclusion.

It is a good time for us to conclude this investigation, which is complex, with many witnesses. I recently spoke with Minister Alexandre de Moraes and with the director general of the PF, and I think we are close to the end for this material to be delivered to the PGR, said Barroso.

With the investigation in its hands, the Prosecutor's Office must decide, possibly in February, whether to file a complaint against the accused, request further proceedings or file the case.

Democracy has matured after being attacked by a campaign of permanent discredit of institutions and false accusations of electoral fraud, Minister Luis Roberto Barroso, president of the Supreme Court, recently said in the magazine.

The Brazilian judicial system was essential to demonstrate that democracy resisted the populist, extremist and authoritarian advance, he stressed.

Two years after January 8, the Supreme Court declared 898 defendants criminally responsible, 371 of them with prison sentences and 527 with the application of alternative punishments. (Text and photo: PL)
