Washington, Jan. 21. - The second season of Donald Trump's administration has barely begun and a lawsuit from the American Civil Liberties Union is already circulating today challenging an anti-immigrant executive order.
The ACLU (for its acronym in English) objected to one of Trump's measures on his first day in office that ends birthright citizenship for children born to undocumented immigrants.
The appeal was filed on behalf of several organizations “with members whose babies born on U.S. soil will be denied citizenship under the order,” the organization said in a statement.
"Denying citizenship to children born in the United States is not only unconstitutional, but is also a reckless and callous repudiation of American values," said Anthony Romero, executive director of the ACLU.
He said “the Trump administration’s overreach is so egregious that we are confident we will ultimately prevail.”
According to the plaintiffs, birthright citizenship is protected by the 14th Amendment to the Constitution, which establishes that every person born or naturalized in the United States and subject to its jurisdiction shall be a citizen of this country and of the state in which he or she resides.
“For families across the United States today, birthright citizenship represents the promise that their children can reach their full potential as Americans,” the lawsuit noted.
A few hours after taking office, President Trump declared a national emergency on the southern border to stop - in accordance with the president's instructions - the “invasion” of undocumented migrants across the southern border.
The Republican ordered the construction of the border wall, reinstated the Remain in Mexico policy, designated drug cartels as “foreign terrorist organizations,” predicted the start of mass deportations and canceled a Joe Biden-era application known as CBP One.
In addition, he provides for the mobilization of military personnel to the border with the aim of stopping illegal entries into the national territory.
Published by the White House, the executive order emphasized that “over the past four years, the United States has suffered a large-scale invasion at an unprecedented level.”
According to the text, “millions of illegal immigrants from nations and regions around the world successfully entered the United States, where they now reside, including potential terrorists, foreign spies, members of cartels, gangs and violent transnational criminal organizations and other hostile actors with malicious intentions.”
Among other reasons, “this cannot continue. A nation without borders is not a nation, and the Federal Government must act urgently and forcefully to end the threats posed by an unsecured border,” Trump added in his order.
